TERMS & CONDTIONS

Explainer to keep things fair for everyone:

• 24 hours notice is required to cancel 1:1 personal training sessions
• Late cancellations are charged in full
• Missed group classes are forfeited
• Training packages are non-refundable and valid for 3 months
• You participate in training at your own risk

Please read the full terms and conditions below before booking services with DTD.

1. Booking and Agreement

By booking, attending, or participating in any personal training or group training session with Don’t Think: Do (DTD) you agree to these Terms and Conditions.Online bookings, package purchases, or attendance at a session constitute acceptance of these Terms.

2. Personal Training (1:1) Cancellation Policy

2.1 If you wish to cancel or reschedule a personal training session you must provide at least 24 hours notice prior to the scheduled session.

2.2 Late cancellations (less than 24 hours notice) will be charged in full and the session will be forfeited.

2.3 If you arrive late your session will still finish at the scheduled time.

2.4 If you arrive more than 15 minutes late, the session may be cancelled and charged in full.

2.5 If your trainer cancels due to illness or unforeseen circumstances the session will be rescheduled or credited.

3. Group Training Sessions

3.1 Group training sessions operate with limited numbers to ensure safe and effective coaching.

3.2 If you cannot attend a class please notify your trainer where possible.

3.3 Missed group training sessions are forfeited and cannot be credited, transferred or refunded.

3.4 Don’t Think: Do reserves the right to adjust class times, locations or trainers if necessary.

4. Reserved Training Time Slots

4.1 Clients may be allocated a regular weekly training time slot.

4.2 Your time slot remains reserved provided you attend regularly.

4.3 If sessions are repeatedly cancelled or missed Don’t Think: Do reserves the right to release the time slot to another client.

4.4 Clients are paying for the trainer’s reserved time as well as the session itself, therefore the cancellation policy applies regardless of the reason for cancellation.

5. Arrival to Training

5.1 Please arrive on time for all sessions.

5.2 Clients should bring a water bottle and towel and wear appropriate training attire.

5.3 Outdoor sessions may require sun protection and weather appropriate clothing.

5.4 Boxing sessions may require cotton under-gloves, available from sports retailers.

6. Payments and Training Packages

6.1 All sessions and packages must be paid in advance unless otherwise agreed.

6.2 Training packages are non-transferable and non-refundable.

6.3 Packages must be used within three months of purchase unless otherwise agreed.

6.4 Prices may be updated periodically. Existing packages will be honoured at the price paid.

7. Refunds, Credits and Session Freezes

7.1 Don’t Think: Do does not offer refunds on group training sessions or 1:1 packages.

7.2 At the trainer’s discretion limited rescheduling may be permitted for 1:1 sessions:

• maximum 1 reschedule per 5 session pack
• maximum 2 reschedules per 10 session pack

7.3 If a trainer cancels a session due to illness or emergency the session will be credited or rescheduled.

7.4 If you become ill or injured and a medical practitioner advises you to stop exercising temporarily your remaining sessions may be frozen for up to three months.

8. Session Length

8.1 Personal training sessions are typically 30, 45 or 60 minutes unless otherwise arranged.

8.2 Session time may include warm-up and cool-down periods where appropriate.

9. Health Screening and Fitness Assessment

9.1 Before commencing training you may be asked to complete a health questionnaire and answer personal medical questions, it is your responsibility to be cleared for exercise by your doctor- see medical disclaimer below.

9.2 You may also be asked to perform physical assessments to determine your current level of fitness.

9.3 Your participation in these assessments is voluntary.

9.4 The information collected will be used to design an appropriate training program.

9.5 You confirm that to the best of your knowledge all information provided is accurate and complete.

9.6 You agree to inform your trainer in writing straight away if there are any changes to your health, injuries, medications or medical conditions while training with Don’t Think: Do.

10. Medical Disclaimer

10.1 Personal trainers are not medical professionals and are not qualified to diagnose medical conditions.

10.2 If you have concerns regarding your health you should consult a qualified medical practitioner before participating in exercise.

10.3 You acknowledge that you are in sufficient physical condition to participate in exercise, or that you have obtained appropriate medical clearance.

11. Assumption of Risk

11.1 Participation in exercise carries inherent risks including but not limited to:

• muscle soreness
• strains or sprains
• aggravation of existing injuries
• accidents during exercise.

11.2 By participating in training you voluntarily assume all risks associated with exercise.

12. Injury During Training

12.1 If you experience pain, dizziness, discomfort or unusual symptoms during training you must stop exercising immediately and inform your trainer.

12.2 Your trainer may modify or stop an exercise or session if they believe continuing could pose a risk.

12.3 Continuing exercise against trainer advice is at your own risk.

13. Results Disclaimer

13.1 Fitness results vary between individuals and depend on nutrition, lifestyle, consistency and personal commitment.

13.2 Don’t Think: Do does not guarantee specific results, including weight loss, muscle gain or performance outcomes.

14. Privacy and Confidentiality

14.1 Personal and health information collected will be treated as private and confidential.

14.2 Information will be handled in accordance with Australian privacy legislation and the Don’t Think: Do Privacy Policy.

15. Behaviour and Safety

15.1 Clients are expected to behave respectfully toward trainers and other participants.

15.2 Don’t Think: Do reserves the right to refuse or terminate training services if behaviour is unsafe, inappropriate or disruptive.

16. Limitation of Liability 

16.1 Training services provided by Don’t Think: Do are recreational services under the Competition and Consumer Act 2010 (Cth).

16.2 To the extent permitted by law Don’t Think: Do, Chantal Cain and any associated trainers exclude liability for injury, loss or damage arising from participation in training where such liability may legally be excluded.

16.3 Nothing in these Terms excludes rights under Australian Consumer Law that cannot be excluded.

17. Photography & Marketing

17.1 From time to time Don’t Think: Do may take photographs or short videos during training sessions, classes or events for marketing, social media, website content and promotional purposes.

17.2 By participating in training with Don’t Think: Do you consent to the use of images or video in which you may appear for these purposes.

17.3 If you prefer not to appear in photographs or video, you may opt out at any time by notifying your trainer. Don’t Think: Do will make reasonable efforts to ensure you are not included in future media content.

17.4 Images will be used respectfully and will not be used in a misleading or inappropriate manner.

18. Acceptance of Terms

18.1 By booking or attending training with Don’t Think: Do you confirm that:

• you have read and understood these Terms and Conditions
• you agree to the cancellation and payment policies
• you acknowledge the assumption of risk and liability provisions

Booking a session, purchasing a package, or attending training constitutes acceptance of these Terms and Conditions.
